Boys & Girls Clubs of America (“BGCA”) is a national organization that serves local independent member organizations (“Local Boys & Girls Clubs”). Together Boys & Girls Clubs of America and Local Boys & Girls Clubs form one of the nation’s largest networks of local youth organizations. Boys & Girls Clubs are dedicated to promoting the health, social, educational, vocational and character development of youth throughout the United States of America.

Each Boys & Girls Club organization is a separate legal entity; is governed by an independent board of directors, executive committee, or other governing body; and is solely responsible for its own affairs, including, but not limited to, matters of safety, compliance with federal, state, and local laws, physical facilities, uses of technology, finances, policies and programs, and personnel policies and decisions. Each Local Boys & Girls Club has sole authority to hire, terminate, prescribe the duties of and establish the terms of employment of its employees and officers.

As the national organization, Boys & Girls Clubs of America has no authority with respect to the policies or decisions of Local Boys & Girls Clubs. Accordingly, each Local Boys & Girls Club controls its own affairs, and Boys & Girls Clubs of America does not control and cannot be held responsible for the actions of Local Boys & Girls Clubs.

Children’s Privacy Policy

Youth-Specific Policies

The Children's Online Privacy Protection Act of 1998 protects the personal information of children under the age of 13. This applies to individually identifiable information about a child that is collected online, such as full name, home address, e-mail address, telephone number or any other information that would allow someone to identify or contact the child. Because we are a non-profit and for other reasons, BGCA is exempt from COPPA. The provision of a safe and secure online experience is, however, of the utmost importance to BGCA, and we implement important COPPA concepts voluntarily in order to protect the privacy of children.

Information Collected from Non-Member Children

BGCA does not intend to collect personal information from children under the age of 13 that are not already members of a Boys & Girls Club. Children under the age of 13 that are not members of a Boys & Girls Club may not sign up for Virtual Club or provide any personally identifiable information without consent from a parent or legal guardian. We recommend that parents approve and closely supervise the activity of their children at this and all other online sites and discuss with their children restrictions regarding the online release of personal information to anyone they don't know.

Information Collected from Member Children

We do not collect personal information in connection with use of the site unless a user registers, in which case we collect the information requested on our forms, which includes first name and last name, birthdate, the name of the Club the child attends, and the name of the organization that runs that Club. We only collect and store as much information about a child as is reasonably necessary for the child to participate in the site, and we do not condition his or her participation on the disclosure of more personal information than is reasonably necessary.

Information Posted By Children

Children own the rights to the content they create and post to the Virtual Club website, but posting that content to Virtual Club gives BGCA a non-exclusive, transferable, royalty-free, worldwide license to use, publish, reproduce, display, and prepare derivative works of that content elsewhere on Virtual Club and in connection with BGCA, including without limitation for promoting Virtual Club, BGCA, and Boys & Girls Clubs. BGCA will not use any content that contains a child's image, likeness, or voice without permission from the child and his or her guardian. BGCA will never sell or provide a child's content or personal information to a third party without permission from the child and his or her guardian. We encourage parents to educate their children about safe Internet use and to carefully monitor their children's posting.

We cannot control the actions of third parties with whom your child shares his or her information. Our Practices for Disclosing Children's Information In accordance with the terms of our general privacy policy, we do not share, sell, rent, or transfer children's personal information, except: If we are required to do so by law or legal process, such as to comply with any court order or subpoena or to respond to any government or regulatory request; and If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our users or ourselves, including to protect the safety of a child.

Accessing, Correcting, and Deleting Your Child's Personal Information At any time, you may review your child's personal information maintained by us, require us to correct or delete the personal information, or refuse to permit us from further collecting, storing, or using the child's information.
